Personal Information Management Policy

Response Real Estate is committed to protecting your privacy. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), as required of NSW licensed real estate agencies and as outlined in guidance issued by NSW Fair Trading.

This policy explains how we collect, use, disclose and safeguard personal information in the course of providing real estate services.

Note: The Privacy Act does not apply to employee records held by an organisation where the information relates directly to a current or former employment relationship.

What is Personal Information

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not and whether recorded in a material form or not.

Why We Collect Personal Information

We collect personal information only where it is reasonably necessary to:

  • perform our functions as a real estate agency
  • comply with NSW real estate legislation and other applicable laws
  • provide property sales, leasing, and property management services
  • communicate with clients and prospective clients
  • meet record-keeping and identification requirements

Landlords and Prospective Landlords

We collect personal information from landlords and prospective landlords to:

  • act as the landlord's agent
  • manage, lease or sell property
  • provide market appraisals
  • comply with legislative and contractual obligations
  • Information may be disclosed to:
  • tenants or prospective tenants
  • advertising platforms and online property portals
  • tradespeople and service providers
  • owners' corporations
  • valuers and financial institutions
  • government and statutory authorities
  • other parties as required or authorised by law

Tenants and Prospective Tenants

We collect personal information from tenants and prospective tenants to:

  • verify identity
  • assess tenancy applications
  • manage tenancies and repairs
  • conduct inspections
  • meet legal and regulatory requirements

This information may be disclosed to:

  • landlords
  • employment and personal referees
  • tradespeople and maintenance providers
  • owners' corporations
  • government and statutory authorities
  • financial institutions
  • other real estate agents
  • tenancy reference database operators (where permitted by law)

We may obtain information from tenancy reference databases. Where a tenant fails to meet their obligations under a tenancy agreement, information may be listed with tenancy databases in accordance with legislation.

If required information is not provided, we may be unable to process an application or manage a tenancy.

Vendors, Prospective Vendors, Purchasers and Prospective Purchasers

We collect personal information from vendors and prospective vendors to:

  • act under an agency agreement
  • market and sell property
  • provide market appraisals

We collect personal information from purchasers and prospective purchasers to:

  • notify them of properties for sale
  • conduct inspections (including for security and safety purposes)
  • communicate regarding properties they may be interested in

Information may be disclosed to:

  • advertising platforms and media (including online listings)
  • prospective purchasers or vendors
  • pest and building inspectors
  • valuers
  • financial institutions
  • owners' corporations
  • government and statutory authorities
  • other parties as required or authorised by law

Direct Marketing

We may use personal information to provide information about properties, services, or market updates that may be of interest. You may opt out of receiving marketing communications at any time by contacting us or using the unsubscribe option where provided.

Storage and Security of Personal Information

We take reasonable steps to protect personal information from:

  • misuse
  • interference
  • loss
  • unauthorised access, modification or disclosure

Personal information is stored securely in physical and electronic systems. When personal information is no longer required for legal or business purposes, we take reasonable steps to destroy or de-identify it.

Access and Correction

You may request access to the personal information we hold about you and request corrections if the information is inaccurate, incomplete, or out of date. Requests will be handled in accordance with the Privacy Act 1988.

Complaints

If you believe we have breached your privacy, you may lodge a complaint with us. We will investigate and respond within a reasonable timeframe. If you are not satisfied with our response, you may refer the matter to the Office of the Australian Information Commissioner (OAIC).
